Terms of Service

1. The Service

PEKEMA provides software for managing the vehicle lifecycle, including sourcing, inventory, bookings, payments, loans, invoicing, commissions, and inspections. We may add, modify, or discontinue features from time to time.

2. Accounts and Access

Accounts are provisioned by your organisation. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must use the Service only within the role and permissions assigned to you, and you must notify your administrator promptly of any unauthorised use.

3. Acceptable Use

You agree not to:

• access data or features you are not authorised to use;
• upload unlawful, infringing, or malicious content;
• interfere with, disrupt, or attempt to gain unauthorised access to the Service or its infrastructure;
• reverse engineer, copy, or resell the Service except as permitted by law; or
• use the Service in violation of any applicable law or regulation.

4. Your Data

You and your organisation retain ownership of the business and customer data you enter into the Service. You grant us a limited licence to host and process that data solely to provide and improve the Service. You are responsible for ensuring you have the right to submit such data and for the accuracy of the information you enter. Our handling of personal data is described in our Privacy Policy.

5. Intellectual Property

The Service, including its software, design, and content (excluding your data), is owned by PEKEMA and its licensors and is protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the Service other than the limited right to use it as permitted here.

6. Disclaimers

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

7. Limitation of Liability

To the maximum extent permitted by law, PEKEMA will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or related to your use of the Service.

8. Suspension and Termination

We may suspend or terminate access to the Service if you breach these Terms or if necessary to protect the Service or other users. Your organisation may also suspend or remove your account. Upon termination, your right to use the Service ceases immediately.

9. Governing Law

These Terms are governed by the laws of Malaysia, and you submit to the exclusive jurisdiction of the courts of Malaysia in respect of any dispute arising out of or in connection with these Terms or the Service.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
